What’s new this month?

New rules from the EU on the terms and conditions for online platforms such as Amazon, eBay and Google have been adopted, and will also apply in the UK. Particularly beneficial to SME’s, the new rules mean contracts between sellers and the platform must be clear and intelligible and sets out various standards for contracts including information on ranking, relisting and data access.

Although not legislation, the ICO has released a new statutory code aimed at organisations designing online or app-based tools which use or analyse the data of under-18s. The Age Appropriate Design Code has a 12-month transition period but applies to all companies offering services to UK users.

What’s new this month?

The UK continues to take steps to re-open the economy following from lockdown in the first half of the year. The government is taking steps to encourage companies to get back to the office and people back into shops, bars and restaurants, helped in part by the Business and Planning Act which eased rules on the use of outdoor spaces in England, for example.

The much-delayed IR35 passed with the Finance Act The new rules – which will shift responsibility for deciding how contactors should be taxed onto the employing businesses – will now come into force APRIL 2021.

New parents will get a boost. Following a consultation, the government is proposing to extend the redundancy protection period to six months once a new mother has returned to work and extend those protections to those taking adoption leave. Former Women and Equalities Minister Maria Miller has moved a private members’ bill to the same effect.

Since our last update in May, the government has released further guidance on getting back to work safely as and when each industry begins its efforts to get back to normal. The Department for Business, Energy and Industrial Strategy (BEIS) has published back to work guidance to support businesses once an ease in lockdown measures is announced. Some service providers and businesses in the food and hospitality industries are trialing measures to return to work, such as offering delivery services. Some other measures include staggered shift patterns, regular screening protocols and the provision of personal protective equipment (PPE).

The EU flag with the UK's start missing

Since our last update in November 2019, Boris Johnson won the 12 December election with a majority of 80 seats in the House of Commons. This means the Prime Minister, following countless delays, looks set to finally fulfil his promise to “Get Brexit Done”. The UK will leave the EU on 31 January 2020.

Since our last update in July, the Prime Minister was unable to fulfill his pledge to take the UK out of the EU by the end of October 2019. As a result, a general election was called for 12 December 2019.

This regulatory agenda is designed to provide an overview of regulatory changes or new regulations recently passed, proposed, or on the agenda which are relevant to key compliance areas of VinciWorks’ clients in the UK. In this election special, the regulatory agenda will focus on the compliance-related manifesto commitments of the main parties.

Parliament was dissolved on 6 November 2019, so there is currently no legislation in progress. However, government consultations remain in progress, as do EU level developments.
