The 1978 Data Protection Act was amended on 7 October 2016 by Law No. 2016-1321 for a Digital Republic (Digital Republic Law). The amendments were designed to prepare for additional protections on the processing and international transfer of such data as regulated by GDPR.

France’s data protection laws

The Digital Republic Law also introduced the right for minors to be forgotten and to request deletion of any personal data collected when they were under 18. People can also create digital wills to deal with their data posthumously and all electronic communication providers must give users to the option to transfer their data to a designated third party after they die.

The French Data Protection Authority (CNIL) considers consent to only be valid for 13 months at a time, and consent is not valid if it is part of general sales terms or where it originates from pre-ticked boxes. Marketing by post or telephone does not require prior consent, but cannot be done if the recipient has opted out.

As the finer points of GDPR continue to be worked out, different EU members are setting their own limits and standards. In November 2016, the French Supreme Court put an end to IP addresses being considered personal data.

France is already well ahead in terms of preparations for GDPR; however, come implementation day in May 2018, all aspects of the EU Regulation will come into force.
